법원이 “의대 증원을 통한 의료개혁이라는 공공복리에 중대한 영향을 미칠 우려가 있다”며 의료계의 ‘의대 증원 집행정지’ 신청을 받아들이지 않았다. 이로써 정부의 의대 정원 증원 방침은 탄력을 받게 됐다. 서울고등법원 행정7부(구회근 부장판사)는 16일 전공의·의대생과 의대 진학을 희망하는 수험생 등 18명이 보건복지부·교육부 장관을 상대로 낸 의대 정원 증원 집행정지 항고심에서 각하 및 기각 결정을 내렸다. 재판부는 먼저 의대 교수들과 전공의, 의대 준비생, 의대 재학생들의 집행정지 신청 자격을 살폈다. 1심에서는 ‘신청인의 적격’이 ‘각 대학의 장’에게 있다고 판단하고 집행정지 신청을 낸 이들은 모두 신청인 적격이 없다고 판단해 각하했다. 신청인 적격이란 신청인이 될 수 있는 알맞은 자격을 뜻한다. 쉽게 말해 1심에서는 신청인 모두가 이번 사안에 대한 직접 당사자가 아닌 ‘제3자’이기 때문에 집행정지 신청을 할 자격이 없다고 본 것이다. 하지만 고등법원은 의대 재학생들이 ‘신청인 적격’이 있다고 판단했다. 재판부는 “의대생 신청인들은 행정처분의 직접 상대방이 아닌 제3자의 경우라 하더라도 당해 행정처분으로 인해 법률상 보호되는 이익을 침해당한 경우에는 취소소송을 제기해 그 당부의 판단을 받을 자격이 있고 당연히 집행정지도 신청할 수...
